Field Agent: Privacy Policy

Introduction

Field Agent understands that you are concerned about how your personal information is used and shared, and we appreciate you trusting that we will be careful and sensible with your information. This notice describes the Privacy Policy applicable to Field Agent, our services, and our practices for collecting, using, maintaining, protecting and disclosing that information. By visiting the Field Agent Platform (as defined below), you are accepting the practices described in this Privacy Notice.

For purposes of this Privacy Policy, (a) "Field Agent", "we", "us" or "our" means Field Agent Inc., a Delaware Corporation, (b) "Site" means the Field Agent website located at www.fieldagent.net, and any successor or replacement websites, (c) "App" means the Field Agent mobile app, available on the App Store or Google Play, (d) "Services" means any service that are requested by a Client or are provided to Clients on or through the Site or the App, (e) "Affiliate" means any entity controlled by, in control of, or under common control with Field Agent, (f) "Client" means a client of Field Agent that uses the Site or App to request that an Agent perform certain, specified Services, (g) "Agent" means individuals who use the Platform to perform Services for a Client, (h) “Platform” means the Site and the App, and any other software or programs offered by Field Agent, (i) “Users”, “you” or “your” means Clients or Agents who engage with the Platform. 

1. What Personal Information About Users Does Field Agent Gather?

The information we learn from users helps us personalize and continually improve your experience with the Platform. Here are the types of information we gather.

Information You Provide:

We receive and store any information you enter on the Platform or give us in any other way, including the following:

a. Registration Information. To register on the Platform you must provide us your name, phone number and a valid email address. We may also store any other personal information that Users chooses to include on their Field Agent profile, including general demographic information such as income, gender, birthday and zip code. 

b. Payment and Tax Information. In order to process payment transactions, Users may also be required to provide payment account or credit card information and certain tax information.

c. Information Relating to Services. We also receive other types of non-identifying information about you when you provide photos or videos connected to Services requested or performed using the Platform, such as the description of requested Services or the time, date, and place photos or videos were taken.

d. Feedback. We collect any information Users provide to us in response to survey questions and other feedback requests.

You can choose not to provide certain information; however, as a result you might not be able to participate in all Services offered through the Platform. We use the information that you provide for ensuring that you receive information specific to you, responding to your requests, customizing the Platform for you, improving our Platform, and communicating with you.

Automatic Information:

We receive and store certain types of information whenever you interact with us. We may also automatically collect certain information when you provide information to the Platform, such as your location/GPS coordinates (if you enable this feature), a device identifier (but not the UDID), MAC address, and wireless service provider. You can enable or disable location services when you use the App at anytime, through your mobile device settings. However, if you disable location services, you might not be able to participate in any or all tasks provided in the App. This location information is not treated as personal information unless we combine it with or link it to any of the personally identifiable information mentioned above.

Use of Cookies and Tracking Technologies:

 

When you use or access the Platform, or visit a third-party website through which we provide Services, we and certain business partners may use cookies, tracking pixels,  and similar tracking technologies (collectively, "Cookies"). We use Cookies to recognize you as a User; understand how you navigate through the Platform; customize Services and other content to specific Users; measure the effectiveness of certain trials, promotions or other opportunities; perform a wide range of analytics; and to mitigate risk and prevent potential fraud. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Platform.

 

You have the right to choose whether or not to accept Cookies. However, certain Services are only available through the use of Cookies, so if you choose to disable or decline Cookies, your use of certain Services may be limited or not possible. Most web browsers are set to accept Cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser Cookies. To do so, please follow the instructions provided by your browser which are usually located within the "Help" or “Preferences” menu.

Do Not Track: Do Not Track ("DNT") is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not respond to DNT signals.

Information We Receive from Clients:

Field Agent may receive and store information pertaining to the Services performed by an Agent using the Platform, including information pertaining to task acceptance and completion, engagement and performance, Client satisfaction, or fraud and misuse.

Communications:

By registering on the Platform, you will receive emails from Field Agent and/or its Affiliates. As a Field Agent User, it will be necessary for us to communicate with you to provide essential operational, status and transaction updates as well as notices in connection with your account and other information relevant to your participation and use of the Platform (collectively, “Core Communications”). You may not opt out of such Core Communications, and you agree to your receipt of Core Communications via email and/or other communication methods provided by you in your account registration. If we send non-Core Communications such as newsletters we will give you the opportunity to unsubscribe to them.

As a Field Agent App User, we may communicate with you with push notifications and other such notices in connection with your account and other information relevant to your participation and use of the Platform. You may opt out of such notifications by editing your mobile device settings.

2. What Does Field Agent do With the Personal Information It Receives?

Field Agent collects and uses your personal information to:

Create and manage your account;

Process your transactions;

Perform research and analysis aimed at improving our services and technologies;

Provide User support;

Detect and prevent fraud or misuse; and

Display content that is customized to your account.

3. Does Field Agent Share the Personal Information It Receives?

Personal information about our users is an important part of our business, and we are not in the business of selling it to others. Except as set out in this Privacy Policy or in Section 6 of the Agent Participation Agreement, Field Agent does not disclose or sell your personal information to any third parties.

Users:

As a User, we may share certain information in order to facilitate the relationship outlined in the Agent Participation Agreement, the Terms of Service and any agreement between Field Agent and its Clients. We may also share certain information with third-party partners for the purpose of improving or expanding our Platform and/or the Services provided or offered through the use of our Platform, as described in additional detail in Section 6 of the Agent Participation Agreement.

Agents:

We employ third-party companies and individuals to perform functions on our behalf. Examples include analyzing data, processing payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.

Screening:

As the Services offered through our Platform continue to expand, Client may require that certain Services only be made available to Agents who meet certain specifications. We may use your information to determine your eligibility for such Services and to customize your interactions with the Platform accordingly.  

Promotional Offers:

We may also send offers to selected groups of Users on behalf of other businesses. When we do this, we do not give that business your personal information. If you do not want to receive such offers, we will give you the opportunity to unsubscribe to them.

Business Transfers:

As we continue to develop our business, we might sell or buy additional services or business units. In such transactions, User information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the User notifies us otherwise). Also, in the event that Field Agent or substantially all of its assets are acquired, User information will of course be one of the transferred assets.

Protection of Field Agent and Others:

We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Agent Participation Agreement, Terms of Service, agreements with Clients and other similar agreements; or protect the rights, property, or safety of Field Agent, our Users, or others. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from Users for commercial purposes in violation of the commitments set forth in this Privacy Notice.

4. Rights to Access

If you create an account with Field Agent, you may review your account information at any time and, if needed, may edit such information by contacting our support team. You can also close your account by contacting us with a request that we delete your account and information. We will take steps to delete your information as soon as practical, but some information may remain in archived/backup copies for our records and as otherwise required by law.

5. Participation Agreement, Notices and Revisions

If you choose to visit or use our Platform, your visit and any dispute over privacy is subject to this Privacy Notice, our Agent Participation Agreement and our Terms of Service, including limitations on damages, arbitration of disputes, and application of the law of the state of Arkansas. If you have any concern about privacy at Field Agent, please contact us with a thorough description, and we will try to resolve it.

Our business changes constantly, and our Privacy Notice, the Agent Participation Agreement and Terms of Service will change also. We may e-mail periodic reminders of our notices and conditions, but you should check our Site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of user information collected in the past without the consent of affected users.

6. Third Party Services

We may use Plaid, Inc. (“Plaid”) to connect your Field Agent account with your bank account and to verify your bank account information. Information shared with Plaid is treated by Plaid in accordance with its Privacy Policy, available at https://plaid.com/legal/#end-user-privacy-policy.

7. California and Vermont Privacy Rights

a. California. California Civil Code Section § 1798.83 permits Users of the Field Agent Platform that are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third-parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, Field Agent currently does not share any personal information with third parties for their direct marketing purposes.  If your Field Agent account has a California mailing address, we will not share personal information we collect about you except to the extent permitted under California law.

b. Vermont. If your Field Agent account has a Vermont mailing address, we will not share personal information we collect about you with non-affiliates unless the law allows or you provide authorization.

8. How Secure Is Information About Me?

We protect your information during transmission by using Secure Socket Layer (SSL) software, which encrypts information you input.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer. We are not responsible for circumvention of any privacy settings or security measures contained on the Field Agent Platform. It is your responsibility to protect the security of your login information. Please help keep your account safe by using a strong password. The safety and security of your information also depends on you.

9. Children

Our Privacy Policy expressly limits Users to individuals who are 18 years of age or older, and our Platform is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13, and if we learn we have collected or received personal information from a child under 13, we will delete that information. You must be at least 18 years old in order to create a Dwolla account.
